Terms & Conditions

1. General

1.1 These general terms and conditions ("Terms") apply to Serculate AB org. no. 556898-2192, Trollsjövägen 27, 132 46 Stockholm, e-mail: hej@serculate.com, ("Serculate") provides the platform for submission of used goods ("Platform").

1.2 To use the Platform, you must be at least 18 years old and authorized to enter into an agreement with Serculate.

‍

1.3 By creating an account in the Serculate Platform (“Serculate Account”) and using the Platform, you agree to the Terms and enter into an agreement with Serculate that provides the Platform in accordance with these Terms.

1.4 A Serculate account gives you the opportunity to use the Platform and various parts that are


- Digital submission of second-hand goods to merchants connected to the Platform
- Request payouts by merchants connected to the Platform
- Digital interfaces for mobile to communicate with merchants connected to the Platform
- Receive requests for submission of second-hand goods by merchants connected to the Platform

2. Permitted use
‍

2.1 It is not permitted to copy, modify, distribute or publish content provided by Serculate. It is not permitted to use the service on an unauthorized service that may damage the Platform.

2.2 You are responsible for what you upload on the Platform. You yourself protect your login details from unauthorized access to your Serculate account.

2.3 Your use of the Platform is subject to these Terms

3. Personal data processing
‍

3.1 The use of the Platform means that personal data is processed. Processing takes place according to Serculate's privacy policy, which is part of these Terms and Conditions.

4. Serculate's liability and breach of contract
‍

4.1 Serculate has the right to block and suspend you as a user and terminate your Serculate account if you violate the Terms or use the Platform in a way that may cause direct or indirect

damage to Serculate or third parties.

‍

4.2 Serculate offers the platform without any guarantees and the use of the service is at your own risk. Serculate cannot be held responsible for any damage that may occur with the service. Serculate makes no guarantees of functionality, uptime or service interruption beyond the law.

5. Force Majeure
‍

Serculate or you are not responsible for delay, loss or other damage that is due to circumstances beyond the control of the party that defend the performance.

‍

6. The agreement and terms
‍

6.1 Serculate can change the terms of the platform and will notify you in a reasonable time of the changes to the terms

‍

6.2 You have the right to terminate the agreement with Serculate if you do not accept the new Terms and Conditions. If you do not terminate the agreement, you are deemed to have accepted the changes.

‍

6.3 Your agreement with Serculate applies until further notice in accordance with these Terms. You have the right to terminate the Agreement and Terminate your Serculate account at any time.

7. Miscellaneous and complaints
‍

7.1 Complaints about the Platform should be sent to e-mail hej@serculate.io

It is also possible to contact the Allmänna Reklamationsnämnden (ARN), which is an authority with an impartial role that tries disputes between consumers and companies and makes decisions on how the dispute should be resolved.

7.2 Serculate is entitled to assign its obligations and rights under these Terms. Serculate has the right to use and hire subcontractors to fulfill its obligations.
